Types of Work Injuries Covered Under California Law
California's workers' compensation system covers virtually every type of injury or illness that arises out of and in the course of employment. Under Labor Code Section 3208, an injury includes both physical injuries and psychiatric injuries caused by work-related events or conditions.
Specific Injuries
A specific injury (Labor Code Section 3208.1) is caused by a single incident or exposure β such as a fall, a struck-by accident, a lifting injury, or a chemical exposure event. These injuries have a clear date of occurrence, making the date of injury straightforward to establish.
Cumulative Trauma Injuries
A cumulative trauma injury (Labor Code Section 3208.1) results from repetitive physically or mentally traumatic activities extending over time. These injuries develop gradually β such as carpal tunnel syndrome from years of typing, back injuries from repetitive heavy lifting, hearing loss from chronic noise exposure, or knee deterioration from years of kneeling or climbing. The date of injury for cumulative trauma is the date you first suffered disability and either knew or should have known the disability was caused by your work (Labor Code Section 5412).
Occupational Diseases
Work-related illnesses β including respiratory diseases, cancers, skin conditions, and infections β are compensable under workers' compensation. Certain occupations carry statutory presumptions of industrial causation. For example, under Labor Code Sections 3212-3213, firefighters, law enforcement officers, and certain other safety personnel benefit from presumptions that specific conditions (cancer, heart disease, pneumonia, tuberculosis, meningitis, MRSA, and blood-borne infectious diseases) are work-related.
Psychiatric Injuries
Work-related psychiatric injuries β including stress, anxiety, depression, and PTSD β are compensable under Labor Code Section 3208.3, subject to certain requirements. Generally, the employee must have been employed for at least six months, and the work-related events must be the predominant cause (more than 50%) of the psychiatric injury. Exceptions exist for injuries caused by sudden and extraordinary employment conditions or workplace violence.
What to Do After a Work Injury in California
The steps you take immediately after a work injury can significantly impact your workers' compensation claim:
1. Seek immediate medical attention. Your health is the priority. If your injury is an emergency, call 911 or go to the nearest emergency room. For non-emergency injuries, notify your employer and seek treatment through the employer's Medical Provider Network (MPN). During the first 30 days, you must generally treat within the MPN unless you pre-designated a personal physician before the injury (Labor Code Section 4600).
2. Report the injury to your employer. Under Labor Code Section 5400, you must report your injury within 30 days. Report in writing if possible, and keep a copy for your records. Be specific about what happened, what body parts are affected, and when the injury occurred.
3. Complete the DWC-1 Claim Form. Your employer must provide this form within one working day of learning about your injury (Labor Code Section 5401). Complete your portion, keep a copy, and return it to your employer. Filing the DWC-1 formally initiates your workers' compensation claim.
4. Document everything. Keep records of all medical visits, prescriptions, mileage for medical appointments, and any out-of-pocket expenses. Document how your injury affects your daily activities and work abilities. If there were witnesses to your injury, get their contact information.
5. Contact a workers' compensation attorney. The workers' compensation system is complex, and insurance companies have teams of adjusters and lawyers working to minimize your benefits. Benefits Available for Work Injuries in California
California's workers' compensation system provides several categories of benefits for injured workers:
Medical Treatment: All reasonably necessary medical care to cure or relieve the effects of your work injury, including surgery, physical therapy, medications, diagnostic testing, and medical equipment (Labor Code Section 4600).
Temporary Disability: Wage replacement at two-thirds of your average weekly earnings while you are recovering and unable to work or are working at reduced capacity (Labor Code Sections 4653-4657). The 2024 maximum rate is $1,619.15 per week.
Permanent Disability: Compensation for lasting impairment based on your disability rating under the PDRS (Labor Code Sections 4658-4664). Ratings range from 0% to 100%.
Supplemental Job Displacement: A voucher of up to $6,000 for retraining if your employer cannot accommodate your work restrictions (Labor Code Section 4658.7).
Death Benefits: Compensation for dependents if a work injury results in death, ranging from $250,000 to $320,000 plus burial expenses (Labor Code Sections 4701-4707).
Your Rights as an Injured Worker
California law provides important protections for injured workers:
- Right to file a claim β Your employer cannot prevent you from filing a workers' compensation claim
- Right to medical treatment β You are entitled to reasonably necessary treatment paid by the insurer
- Right to see your own doctor β After 30 days in the MPN, or if you pre-designated a physician
- Right to temporary disability benefits β If your doctor says you cannot work
- Right to permanent disability benefits β If your injury causes lasting impairment
- Right to return to your job β Employers with 50+ employees must offer you your job back if you can perform it (Labor Code Section 132a)
- Right against retaliation β Your employer cannot fire, demote, or discriminate against you for filing a workers' comp claim (Labor Code Section 132a)
- Right to an attorney β You may be represented by an attorney of your choice at any point in the process
Third-Party Liability Claims
In some cases, a third party (someone other than your employer) may be responsible for your work injury. Common examples include negligent drivers causing injuries during work-related travel, manufacturers of defective equipment or machinery, property owners who maintain unsafe premises, and subcontractors on construction sites. When a third party is liable, you may pursue a personal injury lawsuit in addition to your workers' compensation claim, potentially recovering damages for pain and suffering, full lost wages, and punitive damages β benefits not available through workers' compensation alone. Under Labor Code Section 3852, these claims are separate from your workers' comp case but require careful coordination.
