Back Injuries in California Workers' Compensation
Back injuries are among the most common and most debilitating workplace injuries in California. According to the Bureau of Labor Statistics, back injuries account for approximately one in five workplace injuries and illnesses, and they are the leading cause of disability for workers under the age of 45. Whether caused by a single traumatic event β like a fall or lifting accident β or by years of repetitive physical labor, work-related back injuries can cause chronic pain, limited mobility, and permanent disability that fundamentally changes your quality of life.

Types of Work-Related Back Injuries
Herniated Discs (Disc Herniation)
A herniated disc occurs when the soft inner material of a spinal disc pushes through a crack in the tougher outer layer, potentially pressing on nearby nerves. Herniated discs are common in the lumbar spine (lower back) and cervical spine (neck), causing pain, numbness, tingling, and weakness in the extremities. Work activities that involve heavy lifting, bending, twisting, and vibration frequently cause or aggravate disc herniations. Treatment may include physical therapy, epidural injections, and surgical procedures such as discectomy or disc replacement.
Degenerative Disc Disease
While disc degeneration is a natural aging process, work activities can significantly accelerate this degeneration. Workers who perform repetitive heavy lifting, prolonged sitting with poor ergonomics, or are exposed to whole-body vibration (such as truck drivers and equipment operators) are at substantially higher risk of developing symptomatic degenerative disc disease. In workers' compensation, the key legal issue is whether your work activities caused or contributed to the degeneration beyond what would have occurred naturally β a question that directly impacts apportionment under Labor Code Sections 4663-4664.
Spinal Stenosis
Spinal stenosis is the narrowing of the spinal canal, which can compress the spinal cord and nerve roots. Work-related spinal stenosis may result from cumulative trauma, disc herniations, or post-traumatic bone spurs. Symptoms include back pain, leg pain (sciatica or claudication), numbness, and weakness. Severe cases may require surgical decompression through laminectomy or other procedures.
Compression Fractures
Vertebral compression fractures occur when a vertebra collapses, often due to a fall, heavy impact, or forceful bending. These fractures are particularly common in workers who fall from heights β such as construction workers, roofers, and warehouse workers. Compression fractures can cause severe acute pain, kyphosis (forward curvature), loss of height, and chronic pain. Treatment may include bracing, vertebroplasty, or kyphoplasty.
Muscle Strains and Ligament Sprains
Back strains (muscle tears) and sprains (ligament tears) are the most common type of back injury. While many resolve with conservative treatment, some develop into chronic conditions β particularly when workers are pressured to return to full duty before fully healing, leading to re-injury. Chronic back strains can significantly impact daily functioning and work capacity.
Spinal Cord Injuries
The most severe back injuries involve damage to the spinal cord itself, potentially resulting in partial or complete paralysis. Spinal cord injuries typically result from severe falls, crush accidents, and motor vehicle accidents during work. Under Labor Code Section 4662, injuries resulting in permanent and complete paralysis of both legs, both arms, or one leg and one arm create a conclusive presumption of permanent total disability (100%), entitling the worker to lifetime benefits.
The Apportionment Challenge in Back Injury Claims
Back injury claims are among the most heavily contested workers' compensation cases, primarily because of apportionment disputes. Insurance companies routinely argue that a significant portion of a worker's back disability is due to pre-existing degenerative changes, prior injuries, or natural aging β rather than work activities.
Under Labor Code Sections 4663 and 4664, apportionment of permanent disability is required when multiple factors contribute to the disability. However, the law requires that apportionment be based on substantial medical evidence. This means the medical evaluator must provide specific, reasoned explanations for the percentage attributed to each cause β vague or conclusory apportionment opinions are legally insufficient.

- Demonstrating that pre-existing degenerative findings on imaging were asymptomatic before the work injury and therefore do not warrant apportionment under Escobedo v. Marshalls
- Challenging apportionment opinions that fail to differentiate between pathology (structural findings) and disability (functional limitations)
- Presenting evidence that the worker's job activities caused the degenerative changes rather than age alone
- Arguing that the medical evaluator failed to adequately consider the contribution of industrial activities to the overall condition
- Obtaining supplemental medical opinions that better address the causal relationship between work and disability
Medical Treatment for Work-Related Back Injuries
Under Labor Code Section 4600, injured workers are entitled to all reasonably necessary medical treatment to cure or relieve the effects of the work injury. For back injuries, treatment may include:
- Physical therapy and chiropractic care β typically the first line of treatment
- Pain management β including medications, epidural steroid injections, facet joint injections, and nerve blocks
- Diagnostic imaging β X-rays, MRI, CT scans, and discography
- Surgical intervention β discectomy, laminectomy, spinal fusion, disc replacement, or minimally invasive procedures
- Post-surgical rehabilitation β including physical therapy and work conditioning
- Durable medical equipment β back braces, TENS units, ergonomic equipment
- Chronic pain management β for cases where pain persists despite treatment, including spinal cord stimulators and medication management
Insurance companies frequently deny or delay back injury treatment through the Utilization Review (UR) process. When treatment is denied, you have the right to request an Independent Medical Review (IMR) under Labor Code Section 4610.5. Permanent Disability Ratings for Back Injuries
Back injuries frequently result in significant permanent disability ratings, particularly when they involve surgical intervention, chronic radiculopathy, or multi-level spinal conditions. Under the AMA Guides (5th Edition) and the 2005 PDRS, back injury disability ratings consider:
- Range of motion loss in the spine
- Radiculopathy (nerve involvement) with objective findings
- Surgical history (fusion, decompression, etc.)
- DRE categories for the cervical, thoracic, and lumbar spine
- Pain and sensory deficits
- Occupation and age adjustment factors
A lumbar fusion surgery, for example, typically starts at a minimum DRE Category IV (20-23% WPI) and can be rated higher with additional objective findings. Combined with occupation and age adjustments, significant back injuries frequently result in permanent disability ratings of 30-70% or higher, with corresponding compensation in the tens of thousands to hundreds of thousands of dollars.
