If your workers’ comp claim is disputed, you may need to attend a hearing at the Workers’ Compensation Appeals Board (WCAB). While this can sound intimidating, knowing what to expect can make the process much less stressful.
Types of WCAB Hearings
Mandatory Settlement Conference (MSC)
This is usually the first hearing. Both sides present their positions to a workers’ comp judge and attempt to negotiate a settlement. Most cases settle at this stage.
Trial
If no settlement is reached, the case goes to trial. Unlike a typical courtroom trial, workers’ comp trials are usually decided by a judge (no jury) based primarily on medical reports and testimony.
Expedited Hearing
For urgent issues like delayed medical treatment or unpaid temporary disability, you can request an expedited hearing to get a faster ruling.
What Happens at the Hearing
- Check in — arrive early and check in with the court clerk
- Meet with your attorney — discuss strategy and any last-minute issues
- Pre-trial conference — your attorney and the insurance company’s lawyer meet with the judge to outline the issues
- Testimony — you may be asked to describe your injury, treatment, and how it affects your daily life
- Medical evidence — the judge reviews medical reports, QME/AME evaluations, and other documents
- Decision — the judge issues a ruling, sometimes immediately, sometimes weeks later
How to Prepare
- Review your medical records and know your treatment history
- Be honest and consistent — the judge and insurance defense attorney will look for contradictions
- Dress professionally
- Bring any documents your attorney requests
- Don’t exaggerate — judges can spot embellishment
