Receiving a denial letter for your workers' compensation claim can feel devastating. You are injured, unable to work, and now the insurance company is telling you that your claim does not qualify for benefits. But a denial is not the end of the road. In California, injured workers have robust rights to challenge claim denials through the Workers' Compensation Appeals Board (WCAB), and with the right legal representation, many denied claims are ultimately overturned.

Why Workers' Compensation Claims Get Denied in California

Insurance companies deny workers' compensation claims for many reasons — some legitimate, many not. Understanding the basis for your denial is the first step toward challenging it. Common reasons for denial include:

1. Disputed Injury Causation

The insurer may argue that your injury was not caused by your work activities. This is particularly common with cumulative trauma injuries, repetitive stress injuries, and conditions that develop over time. Under Labor Code Section 3600, the injury must arise out of and in the course of employment (AOE/COE). Insurance companies frequently hire medical evaluators who provide opinions minimizing or denying the connection between your work and your condition.

2. Late Reporting

Under Labor Code Section 5400, you must report your injury to your employer within 30 days. If you reported late, the insurer may use this as grounds for denial. However, exceptions exist — particularly for injuries that develop gradually or where the employer had actual knowledge of the injury. Under Labor Code Section 5402, late reporting does not automatically bar your claim if you can show good cause.

3. Missed Filing Deadlines

California imposes a one-year statute of limitations from the date of injury (Labor Code Section 5405). For cumulative trauma or occupational disease claims, the deadline runs from the date you knew or should have known that your condition was work-related (Labor Code Section 5412). Missing these deadlines can result in denial, though certain circumstances may toll the limitations period.

4. Pre-Existing Conditions

Insurers commonly deny claims by attributing your symptoms to a pre-existing condition rather than a work injury. However, under California's apportionment rules (Labor Code Sections 4663-4664), even if you had a pre-existing condition, you are still entitled to compensation for the portion of your disability caused or aggravated by work. The insurance company cannot deny your entire claim simply because you had a prior condition.

5. Independent Medical Examination (IME) Disputes

The insurance company may send you to a doctor of their choosing who provides an opinion adverse to your claim. These Qualified Medical Evaluators (QMEs) or Agreed Medical Evaluators (AMEs) play a critical role in disputed claims. If the medical evidence conflicts, you have the right to challenge unfavorable opinions through cross-examination, additional medical evidence, or requesting a new QME panel.

6. Surveillance and Fraud Allegations

Some insurers conduct surveillance on injured workers, then use edited video to argue that the worker is not as injured as claimed. They may even allege fraud. These tactics are designed to intimidate injured workers into abandoning their claims. How to Challenge a Denied Workers' Comp Claim

If your workers' compensation claim has been denied, you have the right to dispute the decision through the WCAB. Here is the process:

Step 1: File an Application for Adjudication of Claim. This document, filed with the WCAB, formally opens your case before the workers' compensation court. It identifies the parties, the date of injury, and the body parts affected.

Step 2: Obtain Medical Evidence. The strength of your case depends largely on medical evidence. Your attorney may arrange for evaluation by a QME or AME to obtain an objective medical opinion regarding causation, treatment, and disability. Under Labor Code Section 4062, the QME process involves requesting a panel of three physicians from the DWC Medical Unit and selecting one for your evaluation.

Step 3: Declaration of Readiness to Proceed (DOR). Once medical evidence is obtained and discovery is complete, either party may file a DOR requesting that the case be set for a hearing — either a Mandatory Settlement Conference (MSC) or a Priority Conference.

Step 4: Mandatory Settlement Conference. At the MSC, the parties attempt to resolve the dispute. A workers' compensation judge (WCJ) facilitates negotiations. If settlement is not reached, the case proceeds to trial.

Step 5: Trial Before the WCAB. At trial, both parties present evidence, including medical reports, testimony, and documentary evidence. The WCJ issues a Findings and Award or Order. If you disagree with the decision, you may file a Petition for Reconsideration with the WCAB Commissioners.

Utilization Review and Independent Medical Review Denials

Even when your claim is accepted, the insurance company may deny specific medical treatment through the Utilization Review (UR) process. Under Labor Code Section 4610, all requests for medical treatment must go through UR, where a physician reviews the request against the MTUS guidelines. If treatment is denied or modified, you have the right to request an Independent Medical Review (IMR) under Labor Code Section 4610.5. The IMR is conducted by independent physicians who review your case and determine whether the requested treatment is medically necessary.

Penalties for Unreasonable Claim Denials

California law imposes penalties on insurance companies that unreasonably delay or deny workers' compensation benefits. Under Labor Code Section 5814, if benefits are unreasonably delayed or refused, the injured worker may be entitled to a 25% increase in the compensation owed. Additionally, Labor Code Section 5814.5 allows for recovery of attorney fees when benefits are unreasonably delayed. These penalty provisions serve as important tools for holding insurance companies accountable.
