Appealing Workers' Compensation Decisions in California

When a Workers' Compensation Judge (WCJ) issues an unfavorable decision in your case, or when the insurance company has wrongly denied your claim, you have the right to appeal. California's workers' compensation appeals process provides multiple levels of review to ensure that injured workers receive the benefits they are entitled to under the law. Navigating the appeals process requires detailed knowledge of procedural rules, evidentiary standards, and legal arguments — making representation by a Certified Specialist in Workers' Compensation Law essential.

Levels of Workers' Compensation Appeals in California

1. Trial Before the Workers' Compensation Judge (WCJ)

The first level of adjudication is the trial before a WCJ at one of the WCAB district offices throughout California. At trial, both parties present evidence including medical reports, deposition testimony, lay testimony, and documentary evidence. The WCJ issues a Findings and Award (if benefits are awarded), a Findings and Order (if a procedural ruling is made), or an Opinion on Decision explaining the reasoning. If the WCJ's decision is unfavorable, you have the right to seek further review.

2. Petition for Reconsideration

Under Labor Code Section 5900, any party aggrieved by a WCJ's final order, decision, or award may file a Petition for Reconsideration with the WCAB Commissioners. This petition must be filed within 20 days after service of the decision (Labor Code Section 5903). The grounds for reconsideration include:

  • The WCJ acted without or in excess of their powers
  • The decision was procured by fraud
  • The evidence does not justify the findings of fact
  • The findings of fact do not support the order, decision, or award
  • New evidence has been discovered that could not have been produced at trial with reasonable diligence

The WCAB Commissioners review the trial record and the WCJ's Report on Petition for Reconsideration. They may affirm, rescind, amend, or return the case to the WCJ for further proceedings. The Commissioners must act on the Petition within 60 days, or it is deemed denied by operation of law (Labor Code Section 5909).

3. Petition for Removal

For interlocutory orders — decisions made during the course of the case that are not final decisions — you may file a Petition for Removal under Labor Code Section 5310 and WCAB Rule 10843. This is appropriate when a WCJ's interim ruling threatens to cause irreparable harm or prejudice that cannot be remedied through reconsideration after a final decision. Common examples include orders denying discovery, granting or denying continuances, or ruling on admissibility of critical evidence.

4. Writ of Review (Court of Appeal)

After the WCAB Commissioners have ruled on your Petition for Reconsideration, you may seek further review from the California Court of Appeal through a Writ of Review under Labor Code Section 5950. This petition must be filed within 45 days after the WCAB's decision becomes final. The Court of Appeal reviews whether the WCAB's decision was supported by substantial evidence and whether the WCAB acted within its authority. Writ proceedings require sophisticated appellate legal writing and a thorough understanding of the evidentiary record.

5. California Supreme Court

In rare cases involving significant legal issues, the California Supreme Court may grant review of a Court of Appeal decision through a Petition for Review. This is the final level of appeal in the state system.

Common Issues on Appeal

Workers' compensation appeals frequently involve the following disputed issues:

Medical Evidence Disputes: Challenges to the admissibility or weight of Qualified Medical Evaluator (QME) or Agreed Medical Evaluator (AME) reports. Under Labor Code Section 4061, the QME/AME report generally constitutes presumptive evidence on medical issues, but it can be rebutted by showing that the evaluator failed to follow proper procedures, relied on inaccurate history, or reached conclusions not supported by the medical evidence.

Apportionment: Disputes over how much of your permanent disability is attributable to the work injury versus pre-existing conditions or other factors. Under Labor Code Sections 4663 and 4664, apportionment must be based on substantial medical evidence. Appeals often challenge whether the medical evaluator provided adequate reasoning for their apportionment conclusions.

Permanent Disability Rating: Challenges to the WCJ's calculation of the permanent disability rating, including disputes over the AMA impairment rating, the application of adjustment factors, and the use of the PDRS.

AOE/COE (Arising Out of Employment/Course of Employment): The fundamental question of whether your injury is work-related. Appeals may challenge the WCJ's finding that the injury did or did not arise out of and in the course of employment.

Future Medical Treatment: Disputes over whether your case should remain open for future medical treatment or whether the WCJ erred in closing out medical rights.
