How much does a workers' comp lawyer actually charge?
In California, injured worker attorneys do not bill by the hour. Instead, they work on a contingency fee, meaning they only get paid if you receive money — usually a percentage of your permanent disability award or settlement (Compromise and Release or Stipulated Award). Most fees fall between 12% and 18%, with 15% to 18% being common on contested cases. There's no fixed statutory percentage; instead, the fee has to be "reasonable" and is set case by case.
Unlike car accident or injury lawsuits where 33%-40% contingency fees are typical, workers' comp fees are lower because the Labor Code specifically limits and reviews them. You never pay out of pocket, and you don't owe anything if the attorney doesn't recover benefits for you. This structure is designed so injured workers can get legal help without upfront cost, while keeping fees from eating too much of a benefit meant to replace lost wages and cover injury-related costs.
