In California, Temporary Total Disability (TTD) pays the injured worker two-thirds of average weekly wages while medically unable to work, under Labor Code §4653. TTD continues until the worker returns to work or reaches Maximum Medical Improvement. Yazdchi Law handles California TTD disputes statewide.
Under California Labor Code §4653, Temporary Total Disability (TTD) is the indemnity benefit paid to a California injured worker who is medically unable to work because of an industrial injury. TTD pays two-thirds of the worker's average weekly earnings, subject to a statutory maximum reset annually by the Division of Workers' Compensation. The benefit continues until the worker returns to work, is released to modified duty that the employer can accommodate, or reaches Maximum Medical Improvement under California Labor Code §4660.
Under California Labor Code §4653, California Temporary Total Disability typically starts on the fourth day of lost time from the date the treating physician takes the worker off work — there is a three-day waiting period unless the worker is hospitalized as an in-patient or the lost time exceeds 14 days, in which case TTD is paid retroactively from the first day. The indemnity is paid every two weeks under California Labor Code §4650; late payment triggers a 10% self-imposed increase, and unreasonable delay supports a 25% penalty under California Labor Code §5814.
Under California Labor Code §4653, the TTD rate is two-thirds of the worker's average weekly earnings at the time of injury. Average weekly earnings include base wages, regular overtime, shift differentials, and certain non-wage compensation, but not bonuses tied to performance metrics outside the wage base. The Division of Workers' Compensation publishes the annual California minimum and maximum TTD rates.
Under California Labor Code §4653, California TTD is capped at 104 weeks of payments within five years of the date of injury for most claims. Catastrophic-injury categories have higher caps — hepatitis B and C, amputations, severe burns, HIV, high-velocity eye injuries, chemical burns to the eyes, and pulmonary fibrosis. The 104-week cap runs against the days TTD is actually paid.
When TTD under California Labor Code §4653 ends — typically at Maximum Medical Improvement under California Labor Code §4660 or at the 104-week cap — the California claim transitions to permanent disability indemnity under California Labor Code §4658 on the §4660 rating. Future medical care under California Labor Code §4600 continues subject to California Labor Code §4610 Utilization Review. If the employer cannot accommodate permanent restrictions within 60 days, the worker becomes eligible for the SJDB voucher under California Labor Code §4658.7.
