What benefits does California workers' compensation provide?

Under Labor Code §3600, an employee injured arising out of and in the course of employment is entitled to workers' compensation benefits without proving the employer was at fault. In exchange, the worker generally cannot sue the employer in civil court. The benefit categories are medical treatment, temporary disability while you are off work, permanent disability for lasting impairment, vocational supplemental job displacement (a voucher) where return to old job is not feasible, and death benefits in fatal cases.

Medical care is governed by Labor Code §4600 — the claims administrator must provide reasonable and necessary treatment to cure or relieve the effects of the injury. In practice that means the Medical Provider Network (MPN) controls choice of physician for the first 30 days, with later changes within the MPN allowed in most cases.

How are permanent disability awards calculated?

Permanent disability is rated under the AMA Guides, adjusted for your occupation and age, then expressed as a percentage and converted to weeks of payment under Labor Code §4658. Labor Code §4663 governs apportionment — the insurer may attempt to apportion part of the disability to a prior injury or to non-industrial causes such as aging or unrelated conditions. What if I have to keep working while my case is pending?

Many injured workers stay on the job in modified duty while they treat. If your employer puts you back on full duty before the doctor releases you, document the conflict in writing, ask for the work restrictions in writing, and call (661) 273-1780. What is a Supplemental Job Displacement Benefit?

If you cannot return to your old job because of permanent work restrictions and your employer cannot offer regular, modified, or alternative work within 60 days after a defined milestone, you are entitled to a Supplemental Job Displacement Benefit (SJDB) voucher worth up to $6,000 for retraining at an approved school. Recent injuries also qualify for the Return-to-Work Supplement Program. Both are administered by the Division of Workers' Compensation.

What is Utilization Review and what do I do if it denies my treatment?

Utilization Review (UR) is the process the insurance carrier uses to decide whether a specific treatment your doctor requested is reasonable and necessary. If UR denies or modifies the request, you can appeal through Independent Medical Review (IMR) administered by the Division of Workers' Compensation. Can I file a workers' comp claim for a psychological injury?

Yes, but psychiatric claims have additional requirements. Generally you must have been employed at least six months (continuous or aggregated within the prior five years), and you must prove that actual events of employment were the predominant cause (more than 50 percent) of the psychiatric injury.
