In-home caregivers who work more than 52 hours or earn more than $100 in the 90 days before the injury are required to be covered by the homeowner's workers' compensation insurance — usually a rider on the homeowner's policy. If the homeowner did not carry coverage, the Uninsured Employers Benefits Trust Fund (UEBTF) can step in. Many caregivers are paid in cash but are still employees under California law. Immigration status does not bar a claim.

What is the IHSS program and how does it affect workers' comp?

In-Home Supportive Services (IHSS) is a California program that pays caregivers to care for low-income elderly or disabled individuals at home. IHSS providers are state-employed for workers' comp purposes — claims go through the Department of Social Services workers' compensation program, not the recipient's homeowners insurance. Back, shoulder, and knee injuries from lifting and transferring clients are common, and IHSS providers are entitled to the full range of workers' comp benefits.

What if I was hurt at a construction site without insurance?

California's contractor licensing law requires general and subcontractors to carry workers' comp insurance if they have employees. If you were injured working for an uninsured contractor or in a misclassified arrangement, the Uninsured Employers Benefits Trust Fund (UEBTF) is a fund of last resort. What is a life pension?

For permanent disability rated 70 percent or above (and below 100), California pays an additional weekly amount for life after the basic permanent disability award has been paid out. The life pension rate is set by statute and is in addition to the basic indemnity. For totally disabled workers (100 percent permanent disability), benefits are paid for life at the temporary disability rate. Life pensions are an important component of severely injured workers' settlements.
