Milpitas, California · Workers' Compensation
Milpitas Workers' Comp Lawyer
A Milpitas worker placed at a warehouse, distribution center, or production job through a staffing agency can still seek workers' compensation benefits. State law lets the agency and the business using your labor divide responsibility for coverage by agreement, so you do not have to know which policy applies before you report an injury. The Division of Workers' Compensation (DWC) ZIP locator returns the San Jose district office for Milpitas, though that result does not decide where a case is actually handled. Yazdchi Law is based in Palmdale and reviews each matter individually before deciding whether representation is a fit.

Prepared by Yazdchi Law
Milpitas had about 15.5 million square feet of office, research, and manufacturing space and about 6.5 million square feet of warehouse and distribution space as of 2025, according to the city's demographics page, which names Cisco Systems, KLA, and Western Digital as its three largest employers, with Amazon and Flex among its other major employers. Many warehouse, production, and seasonal jobs behind those numbers are filled through a staffing or temporary agency, not directly by the business running the site. That matters after an injury, because a worker placed by an agency often has two companies to deal with, not one.
Yazdchi Law is based in Palmdale. Call (661) 273-1780 or use the contact form to ask whether the firm can review a California workers' compensation matter. Each claim gets its own review, and representation is decided case by case.
What should I do if a staffing or temp agency placed me at my Milpitas job?
Report the injury in writing to your onsite supervisor at the Milpitas business and to the staffing or placement agency that assigned you, the same day if you can. Do not wait to learn which company's insurance will respond first.
California lets a business secure coverage for workers supplied by another employer, such as a staffing agency, through an agreement between the two companies. Either company's claims administrator could end up handling your file, and you are not expected to sort that out alone before you report the injury.
Keep the contact details and basic facts for both companies in one place. Use this table as a starting checklist.
| Company | Information to collect | Why it matters |
|---|---|---|
| Staffing or placement agency | Full company name, branch address, your recruiter or coordinator's name, and the pay stub that shows the agency as the payer | The agency is often the company that formally employs you and may hold the policy that must respond first. |
| Milpitas business where you worked | Business name, site address, your onsite supervisor's name, and your job title and shift | The business directing your day to day work may also have obligations and relevant safety records. |
| Your own injury record | Date, time, task, witnesses, and the name of anyone you told that day | A dated record protects you no matter which company's insurer ultimately handles the claim. |
Which company's insurance actually pays for my claim?
You may not know at first, and that is normal. California law lets the agency and the business divide that responsibility by agreement, so your job is to report promptly, not to pick the right company in advance.
Under Labor Code section 3602, a business may secure coverage for workers an agency provides to it through a valid agreement with that agency. When that agreement is valid and the coverage was actually obtained, the law treats both companies as having secured compensation for the work. Neither company has to be named correctly on your first call for your claim to move forward.
Reporting quickly still matters. The law generally requires written notice to an employer within 30 days of a work injury, with limited exceptions (see our Labor Code 5400 guide). An employer that then learns of lost time or treatment beyond first aid must send a claim form within one working day (see our Labor Code 5401 guide). Notice to both companies starts both clocks.
What if my claim gets delayed or denied because of the staffing arrangement?
Ask each company which claims administrator is handling the file, and put that question in writing too. A delay while two companies sort out their own agreement is different from a denial of your claim, and each one has its own next step.
If the insurer does not reject liability within 90 days after you file the claim form, the injury is generally presumed compensable; our Labor Code 5402 guide has the details. You generally have one year from the date of injury, or from certain later dates tied to your benefits, to start a proceeding to collect them, covered in the Labor Code 5405 guide. If you do receive a denial, the claim-denial guide covers what to check first.
Before any consultation, gather the two-company table above with pay stubs, placement paperwork, and medical records. The consultation checklist can help you organize a larger file.

Which DWC office serves Milpitas, and does that decide my case?
On October 13, 2026, the DWC ZIP code locator returned the San Jose district office for Milpitas ZIP codes 95035 and 95036. That result names an office. It does not decide venue for a specific case.
The San Jose district office handles the paperwork tied to a Milpitas ZIP code, but venue can still depend on facts such as an employer's address, your actual worksite, or where an existing case was filed. If a staffing agency is involved, the agency's own office address could point to a different ZIP than the Milpitas jobsite.

Where can a Milpitas worker get job search or training help?
NOVAworks is the federally designated workforce board that lists Milpitas among the cities it serves. It is not a DWC office and does not decide a workers' compensation claim.
Milpitas is one of several cities served by NOVAworks, alongside San Mateo County and six other Santa Clara County cities. It lists career advising, training, and job-seeker workshops, and can be reached at (408) 730-7232. Treat it as separate from any job-retraining benefit a workers' compensation claim may include.
A practical next step: build the two-company table above, add the checklist documents, and confirm current DWC contact details before you rely on them. Then call Yazdchi Law at (661) 273-1780 or use the contact form. The firm's office is in Palmdale, and representation is decided case by case.

Frequently Asked Questions
Does it matter whether my paycheck comes from a staffing agency or from the Milpitas business where I worked?
Not for deciding whether to report the injury. California law lets the agency and the business divide responsibility for coverage between themselves by agreement. Report the injury in writing to both right away and let their claims administrators sort out which one handles the file.
What if the staffing agency and the Milpitas business each say the other is responsible?
Put the question in writing to both companies and ask each one for the name of its workers' compensation claims administrator. A dispute between two companies about their own agreement is different from a denial of your claim, and the DWC Information and Assistance Unit can explain the difference if you are not sure which one applies to you.
Does the DWC ZIP code locator decide where my case will be heard?
No. The locator identifies the district office tied to a five-digit ZIP code, which was the San Jose office for Milpitas ZIP codes 95035 and 95036 when we checked on October 13, 2026. Venue for an actual case can depend on other facts, such as an employer's address or where an earlier case was filed.
How long do I have to report a work injury in Milpitas?
California law generally requires written notice to your employer within 30 days of the injury, with limited exceptions. Our Labor Code 5400 guide covers the full rule. Reporting sooner, in writing, to every company involved in your job gives you a clearer record if a question comes up later.
What is a DWC-1 claim form, and who is supposed to give it to me?
The DWC-1 is the form that starts a workers' compensation claim. An employer that learns of lost time or treatment beyond first aid must provide it within one working day, as our Labor Code 5401 guide explains. If a staffing agency placed you, ask whichever company controls your daily work if the other has not sent one.
Can I get help with a Milpitas claim if English is not my first language?
Yes. The Department of Industrial Relations says it works to provide services for people who speak languages other than English and lists phone numbers for requesting an interpreter, including 1-800-736-7401 for workers' compensation questions. It also describes a complaint process if you are not satisfied with the bilingual help you receive.
