Palo Alto, California · Workers' Compensation
Palo Alto Workers' Comp Lawyer
Most Palo Alto jobs are covered by California workers' compensation, including private employers such as HP Inc. A federal government job, like one at the VA hospital in Palo Alto, usually falls under a separate federal law instead, the Federal Employees' Compensation Act. California's DWC ZIP locator points Palo Alto's main ZIP codes to the San Jose district office, though that result is not a venue decision. Yazdchi Law is based in Palmdale, handles California workers' compensation claims, and reviews each matter individually.

Palo Alto's job market is not just one type of employer. The state's own list of major Santa Clara County employers names a private manufacturer and a federal hospital inside city limits. The system that covers a work injury can depend on your employer type, not just where you got hurt. This guide helps a Palo Alto worker sort out which system applies, shows the official DWC ZIP locator result for this area, and points to public workforce help. This is general information, not legal advice for your situation.
Yazdchi Law is based in Palmdale at 1125 W Avenue M-14, Suite A. Call (661) 273-1780 or use the contact form to ask whether the firm can review a Palo Alto work injury matter. The firm reviews each California matter on its own facts before deciding whether representation is a fit.
Does California workers' compensation cover every Palo Alto job?
No. Most Palo Alto jobs are covered by California workers' compensation. A federal government job is usually covered by a separate federal law instead.
The state's Employment Development Department lists major Santa Clara County employers. Two Palo Alto entries show the difference: HP Inc, a private electronics maker, and the VA Palo Alto Health Care System, a federal hospital. A private business here follows the same workers' compensation law as any private business in the state. A federal civil-service job usually follows a different system, the Federal Employees' Compensation Act, or FECA. The table below compares the main categories.
| Type of employer | Example tied to Palo Alto | System that generally applies | Who handles a dispute |
|---|---|---|---|
| Private business | HP Inc, listed in Palo Alto on the state's Santa Clara County major-employer list | California workers' compensation | The Workers' Compensation Appeals Board, through the San Jose DWC office |
| California state, county, or city government | Any state, county, or city government position | California workers' compensation. Labor Code section 3351 includes paid public officers and employees in the definition of a covered worker. | Same board, through the San Jose DWC office |
| U.S. federal government | VA Palo Alto Health Care System, run by the U.S. Department of Veterans Affairs | The Federal Employees' Compensation Act, 5 U.S.C. section 8102, not California workers' compensation | The U.S. Department of Labor, which runs that program under 5 U.S.C. section 8145 |
| Contractor staff placed at a federal site | A private contracting company's own staff working on federal property | Usually still California workers' compensation, through the contracting company, since that company is the employer, not the federal government | Same as a private business; confirm with the contracting company's human resources office |
Not sure which row fits? Ask your own human resources office one question: federal, state or local government, or private company? That answer decides which forms apply next.
What should I do after a job injury at a private Palo Alto employer?
Report the injury, get the claim form, and start a written record right away. These are the same first steps that apply anywhere in California.
Tell a supervisor what happened. Ask for a claim form (DWC 1) and keep a copy. Write down the date, the task, and any witness. Some Palo Alto jobs, like office, lab, and equipment-based manufacturing work, build up from repeated tasks instead of one accident; that kind of claim can run on a different clock. See the cumulative trauma guide. The deadlines below apply to a standard claim.
| Step | Deadline | Law |
|---|---|---|
| Report injury to your employer | Within 30 days | Labor Code 5400 |
| File your workers' comp claim | Within 1 year | Labor Code 5405 |
| Insurer must accept or deny | Within 90 days | Labor Code 5402 |
| First disability check | Within 14 days | Labor Code 4650 |
| Appeal a denied treatment | Within 30 days | Labor Code 4610.5 |
If the claim is delayed, denied, or disputed, see the claim-denial guide and the QME guide for next steps.
What if my employer is a federal agency, such as the VA?
Ask your facility's human resources or workers' compensation office for a federal claim form. A federal government injury is usually not filed with California's DWC.
Federal law says the United States pays compensation for a covered employee's work injury (5 U.S.C. section 8102), and that this federal law is the exclusive remedy, replacing a state workers' compensation law (5 U.S.C. section 8116). The U.S. Department of Labor runs this program, often called FECA, for its own civilian workforce (5 U.S.C. section 8145). A federal civil-service worker at that hospital follows this federal process, not the DWC and WCAB process on this page. Yazdchi Law handles California workers' compensation, not FECA, so your own personnel office is the right first call. A contractor's staff on that same campus is usually a different case; see the contractor row above. And if a Palo Alto job labels you a 1099 contractor rather than an employee at all, the Labor Code section 2775 guide covers that separate classification question.
