San Mateo, California · Workers' Compensation
San Mateo Workers' Comp Lawyer
A San Mateo worker paid through a staffing agency, payroll company, or professional employer organization should get it in writing which business actually secured workers' compensation coverage, since California law lets two employers split that duty by written agreement. The state's DWC ZIP lookup tool lists the San Francisco district office for San Mateo's main ZIP codes, though it does not decide venue. Yazdchi Law is based in Palmdale, has no San Mateo office, and reviews each California workers' compensation matter on its own facts.

The City of San Mateo's own economic development page, checked October 13, 2026, describes a mix of internet start-ups, technology and financial companies, restaurants, and independent retailers. No single employer dominates. The state's major-employer listing for San Mateo County backs that up. It names investment firms such as Fisher Investments and Franklin Resources, a software publisher, and San Mateo County government offices, all located in the city. Many San Mateo workers are paid through a staffing agency, a payroll company, or a professional employer organization (PEO) instead of directly by the business where they work every day.
After a job injury, that raises a question before any other: which business actually secured your workers' compensation coverage? This guide explains how California law answers that, what the state's DWC ZIP lookup tool shows for San Mateo, and where to find verified local help. Yazdchi Law is based in Palmdale and has no office in San Mateo. Call (661) 273-1780 or use the contact form to ask whether the firm can look at a California workers' compensation matter. Each matter is reviewed on its own facts.
Who provides workers' comp coverage when a staffing firm or PEO pays you?
California law lets two employers, such as a staffing agency and the business that directs your daily work, agree in writing that one of them will secure your workers' compensation coverage. If that coverage was actually bought and stays in force, the law treats both businesses as having met the requirement.
This comes from subdivision (d) of Labor Code section 3602. A staffing agency and its client, or a PEO and the company using its payroll service, may divide that duty however their own contract says, as long as one of them actually buys and keeps a valid policy. Either way, your injury is still covered. The open question is only which claims administrator holds the file.
Smaller or newer companies, including some of the start-ups the city's own page describes, often use a staffing firm or a PEO for payroll instead of running that department in-house. That choice does not reduce your right to workers' compensation benefits. It does mean your pay stub may not name the business where you physically work, which can slow down an injury report.
How do you find out which policy covers you?
Ask for the claims administrator's name and a claim number in writing, and compare that against the employer name on your pay stub or offer letter.
Work through these steps in order.
- Pull your most recent pay stub and write down the exact company name listed as your employer.
- Check your offer letter for a staffing or payroll name that differs from where you physically work.
- Tell your supervisor about the injury the same day if you can.
- Ask for the claims administrator's name and a claim number, in writing.
- Keep your own copy of the claim form described in Labor Code section 5400 below.
| Your work arrangement | Who usually takes the first injury report | What to get in writing |
|---|---|---|
| Direct employee of one San Mateo business | Your own supervisor or HR contact | The employer's own claims administrator and claim number |
| Placed by a staffing agency | Often the agency, sometimes the on-site supervisor | Which policy covers the placement, plus the on-site contact's name |
| Paid through a PEO or payroll service | Usually the business where you physically work | The PEO's name and the claims administrator it uses |
If the staffing agency and the host business each point to the other, do not let that cost you the deadline. Labor Code section 5400 generally gives you thirty days after an injury to serve written notice on your employer. When it is unclear which business that is, send written notice to both inside that window; see the Labor Code 5400 guide for the exceptions. A related but separate question is whether you count as an employee at all rather than an independent contractor, which the ABC test guide explains.
Which DWC office serves San Mateo?
On October 13, 2026, the official DWC ZIP code locator returned the San Francisco district office for San Mateo's main ZIP codes. The locator does not decide venue.
94401, 94402, and 94403 are ZIP codes in San Mateo. Each was entered separately into the DWC ZIP code locator, and each returned the same office. A locator result is a starting point, not a ruling on where a case belongs. A worker can live in San Mateo, work for a company based elsewhere, or have a jobsite in another city entirely.
| Resource | What it provides | Current official information checked October 13, 2026 |
|---|---|---|
| DWC ZIP code locator | Finds the DWC district office for a five-digit ZIP code | 94401, 94402, and 94403 each returned the San Francisco district office. General telephone (415) 703-5011. |
| San Francisco DWC district office | Current address and court information | 455 Golden Gate Avenue, 2nd Floor, San Francisco, CA 94102-7014. |
| DWC Information and Assistance Unit | Public help with workers' comp rights, benefits, forms, and procedures | San Francisco I&A line (415) 703-5020. Statewide line 1-800-736-7401 on weekdays. |
| DWC disability accommodations | Requesting an accommodation for a DWC program or service | Coordinators reachable at 1-866-681-1459. Ask as early as possible. |
These four rows are government offices and programs, not Yazdchi Law locations. The Information and Assistance Unit answers general questions about rights and procedures. It does not represent either side in a dispute.

A practical next step for a San Mateo worker
Start with the pay stub, not the job title. Write down the exact employer name, and note any staffing or payroll name on your paperwork. Report the injury in writing within thirty days to every business that might be your employer of record, then check the DWC resources above.

Frequently Asked Questions
Does the DWC ZIP code locator decide where my workers' comp case will be heard?
No. The locator shows which DWC district office currently serves a five-digit ZIP code. It is a starting point for contact information, not a decision about venue. Keep your home, employer, and jobsite addresses available, since any of them can matter to where a case belongs.
A staffing agency placed me at a San Mateo company. Can I still file a workers' comp claim?
Yes. California workers' compensation law covers you whether you are a staffing-agency employee, a PEO employee, or a direct hire. Report the injury in writing to the agency and to the business where you work, and ask each one for its claims administrator's name.
What if the staffing agency and the host company each say the other one covers me?
Put your injury report in writing to both and keep a copy with the date you sent it. Labor Code section 3602 lets two employers divide the duty to secure coverage by their own agreement, so a disagreement between them is not a reason for you to miss the thirty-day notice deadline in Labor Code section 5400.
Does Yazdchi Law have an office in San Mateo?
No. Yazdchi Law is based in Palmdale. Call (661) 273-1780 or use the contact form to ask whether the firm can review a California workers' compensation matter. The firm decides on representation after looking at the facts of each matter.
How long do I have to report a work injury to my employer in California?
Labor Code section 5400 generally requires written notice within thirty days of the injury, with limited exceptions under Labor Code sections 5402 and 5403. Report sooner, in writing, no matter which business turns out to be the right one.
Can NOVAworks help me find a new job while my workers' comp claim is open?
NOVAworks is the publicly funded workforce board for San Mateo County. It offers career coaching, training referrals, and job-search help at no cost, separate from any workers' compensation claim. Contact NOVAworks directly for current eligibility and services.
What is a PEO, and how is it different from a staffing agency?
A professional employer organization, or PEO, typically handles payroll, benefits, and compliance for a client business whose own workers still do their regular jobs there every day. A staffing agency usually recruits and places workers at a separate client's worksite. Either way, ask for the specific company name and claims administrator in writing.
